Terms and Conditions Cactus Academia (English)

Article 1. Definitions

In these terms and conditions the following definitions are given to notion with a capital:

Teacher: Cactus Academia

Student: The person who uses the service of Teacher.

Course: A set of Meetings in which a language is taught.

Meeting: A Meeting at a specific day and time (date) that is agreed upon with Students by Teacher beforehand.

Course fee: The amount to be paid for the Course, agreed upon by Student and Teacher beforehand. This amount equals the amount mentioned on the website plus, if any, administration costs and/or traveling expenses, unless agreed upon otherwise.

Article 2. Application, placement, and subscription

1. Student applies for a Course through the website.

2. Students are placed in order of application.

3. After receiving the payment we will send you the confirmation of registration by email. This is proof of admission and also proof of payment.

4. By registering and paying the course fee, you declare that you agree with all registration conditions.

5. Full courses and waiting lists:

1. When you register for a course that appears to be fully booked, it is possible to place yourself on a waiting list. If a place becomes available or if we organize an extra group, we will contact you.

Article 3. Cancellation period and cancellation costs

1. A week before the start date of the course (in groups), we check whether there are enough registrations to actually allow the course to take place. In case of insufficient interest, we reserve the right to cancel a course. You will receive a message about this as soon as possible, if you do not hear anything, the course will continue as usual.

If you cancel the course (a week before the start date), you will receive a refund of the course fee or you can register for another course.

2. The maximum number of participants is stated in the course (groups) details. In incidental cases, it can be decided to deviate from the maximum number of participants, if the Teacher wills.

Article 4. Changing/rescheduling a Course

It is only possible in exceptional situations. Teacher has the right to cancel a Course or refuse the participation of a Student, stating a clear reason. In this case, Student has the right to get a refund of the paid amount of Student to Teacher concerning the Course.

Article 5. Payment and deadline for payment

1. The Course fee is the amount agreed upon beforehand and is mentioned in the most recent folder or on the website.

2. The payment of the Course fee will occur by paying through the bank account.

5. When payment is not on time, the student is not registered for any course.

Article 6. Placement after starting date in groups

1. Placement after the starting date is possible in agreement with the Teacher.

a. If a Student is placed within the first two Meetings of the Course, the total Course fee is charged.

b. If a Student is placed later the Course fee is adjusted to the remaining Meetings.

Article 7. Course material

Standard Course material is not included in the Course fee unless agreed upon otherwise. The student is responsible for timely have the Course material at hand.

Article 8. Guarantee limitation

The teacher will perform tasks according to best understanding and abilities, and confirming the demands of skilled workmanship. The commitment between Teacher and Student has the character of an effort commitment. The teacher therefore cannot give any guarantees regarding the expected results as an effect of her workmanship.

Article 9. Circumstances beyond one's control and sickness

1. In case of circumstances beyond one's control or in case of sickness of Teacher as a result of which a Meeting cannot be carried out in accordance with the aim of the Meeting, Teacher will notify Student as soon as possible and suggest an alternative date so that the Meeting in question will occur.

2. In case of circumstances beyond one's control and in case of sickness of Teacher, the Student has no right to claim (damage) restitution. Teacher will not charge extra for any extra Meeting that occurs as a result of circumstances beyond one's control and of sickness.

3. In the case of a private Course:

a. Students can reschedule up to two (2) Meetings if announced 24 hours before the Meeting in question.

b. If not announced 24 hours beforehand and/or a Meeting has been rescheduled twice before the Meeting counts as a missed Meeting.

4. A missed Meeting is when Student is not present during a Meeting. No refunds are given for missed Meetings. Student cannot cancel a Course, nor terminate the agreement after the cancellation period in case of circumstances beyond one's control.

Article 10. Reimbursement

All reimbursements towards Students are repaid within 14 working days.

Article 11. Costumer questions and complaints

1. Questions administrative in nature will be answered within five (5) working days. In case the question requires more time, the Teacher will notify Student. The question will at most be answered within three (3) months after submission.

2. Complaints will be answered within fourteen (14) working days. In case the complaint requires more time, the Teacher will notify Student. The complaint will at most be answered within three (3) months after submission.

Article 12. Privacy and confidentiality

Teacher and/or employees of Teacher will treat information given by Student with confidentiality. Teacher confirms to current privacy regulations.

Article 13. General definitions

Opposed to these terms and conditions there might be terms and conditions from Student, in which form these are put or deposited, are not binding for Teacher, unless agreed upon in written form before the start of the agreement.
